On September 1, 2005, China implemented the "Regulations on the Supervision and Administration of Labor Protective Products," marking a significant milestone in the regulation of labor protection equipment. These regulations represent a new era for overseeing safety and health in the workplace, and their implementation is expected to greatly benefit workers by improving working conditions and enhancing occupational safety.
In response to the new regulations, the State Administration of Work Safety has issued various supporting documents, including notices on re-inspection and replacement of testing agencies, guidelines for safety signs on special protective products, and detailed specifications for the inspection and testing of labor protection items. These measures aim to refine the regulatory framework and ensure effective enforcement of the regulations.
Currently, the institutions responsible for testing and inspecting labor protective products are known as "Xxxx Product Quality Supervision and Inspection Centers (Stations)." Originally established during the planned economy era, these agencies were primarily technical service units, offering support to producers, sellers, and users of protective gear. They also play a crucial role in assisting government safety departments with oversight.
To conduct inspections, testing agencies must obtain approval from the State Administration of Work Safety and operate within their authorized scope. Their evaluation follows strict standards, such as GB/T 15481-2000 (equivalent to ISO/IEC 17025:1999) and specific requirements for safety inspection organizations.
Testing agencies are required to strictly adhere to relevant standards when assessing the safety performance of protective equipment and are legally responsible for the accuracy of their reports. If false certificates are issued and this constitutes a crime, criminal liability will be pursued under the Criminal Law. In less severe cases, fines and penalties may apply, and those responsible could face additional legal consequences.
As of April 20, 2006, four national-level testing centers had been approved, including the National Safety Production Wuhan Labor Protection Products Testing and Inspection Center and others in Shanghai and Xuzhou. Provincial agencies were in the process of review and renewal.
The State Administration of Work Safety also maintains a list of special labor protective products, which includes 21 items across six categories. Among them, self-contained air breathing apparatus and long tube masks are relatively new additions. This list helps ensure that only qualified and safe products are used in high-risk environments.
